These Terms & Conditions govern your use of the Hajj & Umrah App, designed and developed by Nukta Solutions, and this website. Please read them carefully. By downloading, browsing, or using the app or this website, you agree to be bound by them.
1. Acceptance of These Terms
By installing or using the app, or by browsing this website, you confirm that you accept these terms and that you are able to enter into a binding agreement, or that a parent or guardian has agreed to them on your behalf. If you do not agree with them, please stop using the app and this website.
2. No Account Required
The app does not currently ask you to create an account or sign in. Features such as your saved du'as, checklist, and counters store your choices only on your own device, and are lost if you uninstall the app or clear its data. If we add account features in the future, we will update these terms to explain how they work.
3. Using the App
You may use the app for your own personal, non-commercial spiritual and travel needs. You agree not to misuse it: no reverse engineering, no attempt to disrupt the service, and no use of its content in a way that breaks the law or the rights of others.
4. Religious and Travel Guidance
Guides, ritual counters, prayer times, Qibla direction, and maps are provided for your convenience and are calculated from publicly available data. They do not replace the guidance of a qualified scholar, the official instructions of the Saudi authorities, or your travel operator, so always verify anything critical to your pilgrimage against those sources, especially before and during travel.
5. Compiled Religious Content
The app's Hajj, Umrah, and other Sharia-related content, including question-and-answer material, is not written by us as original religious rulings. It is collected and compiled from established Islamic books, scholars, and writers, whose origin we credit within the app wherever practical. We aim to remain neutral among differing schools of thought and do not endorse one over another. As this content originates from third-party scholarly sources rather than from our own authority, we disclaim responsibility for any inaccuracy, omission, or scholarly disagreement it may contain, and you should verify anything material to your worship against a qualified scholar or trusted source.
6. AI-Translated Content
The app's content is written in Bangla, its original language, and translated into other languages, including Arabic, Urdu, Hindi, and Indonesian, with the help of AI and machine translation. We have reviewed and verified the English translation, but our other translations are still being reviewed by volunteers and have not been fully verified. As a result, these translations may contain errors in language or meaning, and you should not rely on them where accuracy is critical, particularly for religious or travel guidance.
7. Donations
Donating or volunteering through the app opens your device's browser to our website or a partner site, where any payment is collected and processed by a third-party payment processor under its own terms, separately from the app and not through Apple's or Google's in-app purchase system. Unless the law requires otherwise, donations are non-refundable, and donations made through the app support the development of the app and the projects described at the time of giving.
8. Intellectual Property
The app's design, software, translations, and original written content belong to Nukta Solutions and are protected by intellectual property law. Quranic verses, duas, and other religious or historical material are part of the shared Islamic tradition and are not owned by us; our contribution is in how we have translated, compiled, and presented them. You may not copy, redistribute, or create derivative works from the app's design or software without our written permission.
9. Third-Party Services
The app relies on outside services to work: Google Maps for the maps and location features, Apple's and Google's push notification services if you allow notifications, and our own hosting and content delivery providers. Donate, volunteer, feedback, and social media links open our website or a third party's site in your device's browser. We are not responsible for the content, availability, or privacy practices of any third-party service, and their own terms and privacy policies apply to your use of them.
10. App Store Terms
If you downloaded the app from Apple's App Store, your use is also governed by Apple's standard licensing terms, and Apple has no obligation to provide maintenance or support for the app. If you downloaded it from Google Play, your use is also subject to Google Play's Terms of Service. Apple and Google are not responsible for the app's content or for any claim relating to it; we, not Apple or Google, are solely responsible for the app and its content.
11. Disclaimer of Warranties
The app is provided "as is" and "as available", without warranties of any kind. We do not promise that it will always be uninterrupted, error-free, or accurate for every location and moment.
12. Limitation of Liability
To the fullest extent permitted by law, we are not liable for any indirect or consequential loss arising from your use of the app, including missed rituals, travel disruption, or reliance on the times and directions shown in the app.
13. Governing Law
These terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to its conflict of law rules, and any dispute arising from them will be handled in the courts of that jurisdiction, except where local law gives you the right to bring a claim in your own country of residence.
14. Changes to These Terms
We may revise these terms as the app develops. Continuing to use the app after a revision means you accept the updated terms, and the date above shows when they last changed.
